Terms & Conditions

Important: These Terms govern business-to-business services provided by Home Service Recovery. Your proposal, order form, or service agreement may add plan-specific terms. Please read both before purchasing.

1. Agreement and scope

These Terms & Conditions (“Terms”) are an agreement between Home Service Recovery (“HSR,” “we,” “us,” or “our”) and the business purchasing or using our services (“Customer,” “you,” or “your”). By signing an order form, approving paid service, paying an invoice, or using the services after a trial, you agree to these Terms.

HSR provides business marketing, communications, website, customer-relationship-management, automation, AI-assistant, review-request, reactivation, reporting, and related implementation and management services. Your exact deliverables, start date, pricing, and included usage are stated in your proposal or order form.

2. Onboarding and Customer responsibilities

You will provide accurate business information, content, service details, hours, service areas, policies, pricing information if used, approvals, account access, and other materials reasonably needed to configure the services. You confirm that you have authority to give HSR access to the accounts, phone numbers, domains, calendars, data, and systems you provide.

You remain responsible for your services, prices, estimates, licenses, customer relationships, sales decisions, staffing, scheduling capacity, legal compliance, and the accuracy of information given to callers or leads. You will review configurations and promptly report errors or changes.

3. 14-day trial

If your written offer includes a 14-day free trial, HSR will not charge an HSR setup, management, or software service fee during that trial. The build scope and trial start date must be agreed in writing. No customer-facing change will be launched without required access and approval.

Paid service begins only after you approve moving forward or otherwise accept the paid order form. Third-party, carrier, telephone, messaging, domain, advertising, payment-processing, or other pass-through charges are not included in the free trial unless HSR expressly agrees otherwise in writing.

4. Fees, billing, and usage charges

You agree to pay the setup, subscription, usage, add-on, tax, and pass-through charges stated in your order form. Recurring fees are billed in advance unless the order form says otherwise. Usage-based and third-party charges may be billed in arrears.

“Unlimited” email, messaging, edits, or similar plan language means normal, good-faith business use subject to carrier rules, platform limits, deliverability standards, acceptable-use requirements, and any fair-use terms in your order form. It does not include abusive, unlawful, unusually high-volume, or technically disruptive use. HSR may require a plan adjustment for materially excessive use after discussing it with you.

Failed or overdue payments may result in paused workflows, disconnected third-party services, delayed work, or suspension after reasonable notice. Except for the guarantee below or a written agreement stating otherwise, paid fees are non-refundable.

5. Month-to-month service and cancellation

Unless your order form states a different term, paid management is month-to-month. You may cancel before the next renewal by giving written notice through the contact method in your order form. Cancellation stops future renewals but does not erase charges already incurred or work already approved.

After cancellation, access, transfer, export, porting, and transition assistance are subject to account status, third-party rules, technical feasibility, and any transition work stated in the order form. You stay because the service works—not because you are locked into a long-term contract.

6. Calls, texts, email, consent, and acceptable use

You are the sender or caller for communications made on behalf of your business. You are responsible for having a lawful basis and any required consent for calls, texts, emails, recording, automated outreach, AI-generated or prerecorded voice, and marketing communications. You must honor opt-outs, do-not-call requests, quiet hours, recording laws, carrier requirements, and all other applicable federal, state, and local rules.

You will not use the services for spam, purchased lists without appropriate rights and consent, deceptive messages, unlawful discrimination, harassment, emergencies, illegal products or services, or content that infringes another party’s rights. HSR may refuse, suspend, or modify a workflow that reasonably appears unlawful, unsafe, deceptive, or likely to harm deliverability or platform standing.

7. AI receptionist and human oversight

AI systems can misunderstand callers, produce inaccurate responses, or fail. They are not emergency services, professional advisors, or a substitute for human review. Do not route 911, life-safety, medical, legal, financial, or other high-risk decisions to the AI receptionist.

HSR will configure the agent using the information and instructions you approve. If it cannot answer confidently, it should capture the request and escalate it according to the approved workflow. You are responsible for reviewing call summaries, transcripts, escalations, pricing statements, and performance and for promptly correcting outdated information.

8. Websites, domains, content, and SEO

You keep ownership of your pre-existing domain, brand assets, customer data, and content. You grant HSR permission to use them to deliver the services. You represent that materials you provide may lawfully be used.

Website migrations are handled with reasonable care, including URL mapping and redirects when included, but search rankings, traffic, indexing, ad performance, deliverability, and third-party platform decisions cannot be guaranteed. HSR retains ownership of its pre-existing templates, code, methods, prompts, automations, documentation, and general know-how. Your order form controls any license, export, or transfer of HSR-created materials after cancellation.

9. Customer data and third-party platforms

You authorize HSR and its service providers to process customer and lead data as needed to provide the services. You will not provide sensitive personal information unless it is necessary, lawful, and approved in writing. You are responsible for required privacy notices and permissions for the data you collect.

The services may rely on independent platforms such as phone carriers, email and messaging providers, AI providers, payment processors, CRM systems, calendars, hosting services, Google, Meta, and field-service software. Their terms, pricing, availability, security, and decisions are outside HSR’s control. HSR is not responsible for outages, account suspensions, policy changes, or data loss caused by a third party, but will make reasonable efforts to help diagnose issues within the agreed scope.

10. 90-Day Money-Back Guarantee

The Guarantee

If, during your first 90 paid days using Home Service Recovery, the system does not generate or recover at least as much attributable revenue for your business as you paid in qualifying Home Service Recovery subscription fees during that period, we will refund those qualifying fees, subject to the requirements and exclusions below.

Eligibility requirements

To qualify, the Customer must:

  1. Maintain sufficient legitimate opportunity volume. Your business must receive a reasonable volume of legitimate inbound calls, messages, leads, or other opportunities for HSR to process.
  2. Have recoverable opportunities. There must be enough missed calls, unanswered inquiries, unresponsive leads, past customers, or other eligible opportunities supported by your plan for the system to act on.
  3. Keep HSR active for the full 90-day period. Required software, numbers, automations, integrations, AI agents, workflows, and applicable features must remain active and operational.
  4. Complete onboarding and implementation. You must provide requested information, permissions, access, integrations, approvals, and materials on time.
  5. Use the system as intended. You may not intentionally disable, bypass, substantially modify, or interfere with workflows, routing, agents, tracking, or other systems used to generate or measure opportunities.
  6. Respond to recovered opportunities. You must make reasonable efforts to respond, follow up, provide estimates, attend appointments, and close opportunities that require action from your business.
  7. Maintain normal business operations. Your business must remain reasonably available to accept customers and maintain the staffing, capacity, licensing, service area, and resources needed to perform the services you sell.
  8. Allow accurate tracking. HSR must be permitted to track relevant calls, messages, appointments, leads, and attributable revenue. You must provide reasonable documentation of closed jobs and collected revenue upon request.

How results are calculated

Recovered Revenue means revenue actually collected by the Customer during the guarantee period that can reasonably be attributed to an opportunity generated, recovered, reactivated, booked, or materially assisted by HSR.

For example, if a caller initially goes unanswered, HSR engages that caller, the caller books a service appointment, and the business collects $2,500 from that customer, that $2,500 may count as Recovered Revenue. Revenue that cannot reasonably be connected to HSR does not count.

The comparison is between qualifying HSR subscription fees paid during the initial 90 paid days and verified Recovered Revenue attributable to HSR during that same period.

Exclusions

The guarantee does not apply when results are materially affected by circumstances outside HSR’s reasonable control, including:

  • Insufficient inbound lead, call, or recoverable-opportunity volume;
  • Failure to answer, follow up with, estimate for, or reasonably pursue recovered leads;
  • Customer cancellations, rescheduling, no-shows, or failure to attend appointments;
  • Inability or unwillingness to provide the requested service;
  • Uncompetitive pricing, sales performance, or failure to close legitimate opportunities;
  • Unapproved changes to phone systems, integrations, workflows, automations, or software;
  • Disconnected numbers, expired payment methods, suspended accounts, or third-party outages;
  • Fraudulent, spam, duplicate, or invalid leads;
  • Failure to complete onboarding or provide required access or information; or
  • A material violation of these Terms or the applicable order form.

Requesting a refund

You must submit a written guarantee claim within 14 calendar days after the end of the initial 90-day guarantee period. You must provide information reasonably requested to verify eligibility and calculate attributable revenue.

If you satisfy these requirements and verified Recovered Revenue is less than the qualifying HSR subscription fees paid during the guarantee period, HSR will refund the applicable qualifying subscription fees. Refunds do not include third-party charges, usage-based fees, telecommunications charges, advertising spend, payment-processing fees, optional add-ons, taxes, or other pass-through expenses unless expressly included in writing.

Good-faith requirement

This guarantee is for businesses that actively implement and use HSR in good faith. It does not guarantee results when the Customer does not give the system a reasonable opportunity to perform. A claim may be denied for intentional manipulation of tracking or reporting, deliberate interference with the system, or material failure to satisfy the eligibility requirements above.

11. Results, examples, and testimonials

Calculators, before-and-after descriptions, revenue examples, “imagine being able to say this” scenarios, and similar content are illustrative only unless expressly identified as verified Customer results. They are not promises, predictions, or statements of typical performance. Actual results vary based on opportunity volume, market, response time, offer, pricing, sales ability, staffing, capacity, job value, follow-up, and other factors.

Testimonials must reflect the speaker’s honest experience. A testimonial about prior website, funnel, automation, or support work should not be interpreted as a claim that the speaker used HSR or achieved HVAC revenue-recovery results.

12. Service standards and disclaimers

HSR will provide the services with commercially reasonable care. Except for express written commitments and the guarantee above, the services are provided “as is” and “as available.” To the fullest extent permitted by law, HSR disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and specific business results.

13. Limitation of liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, or for lost profits, lost data, lost goodwill, or lost business opportunity arising from the services. HSR’s total liability for claims other than an approved guarantee refund will not exceed the HSR service fees you paid during the three months immediately before the event giving rise to the claim. This limitation does not apply where prohibited by law.

14. Indemnification

You will defend and indemnify HSR from third-party claims, penalties, losses, and reasonable costs arising from your business services, your content or data, lack of required communication consent, unlawful or deceptive instructions, infringement, or your material breach of these Terms. HSR will promptly notify you and reasonably cooperate in the defense.

15. Suspension and termination

Either party may terminate for a material breach that remains uncured after reasonable written notice. HSR may immediately suspend use that creates legal, security, safety, deliverability, payment, platform, or reputational risk. Sections that by their nature should survive—such as payment obligations, ownership, disclaimers, limitations, indemnification, and dispute terms—survive termination.

16. Changes, order of precedence, and governing terms

HSR may update these Terms for future service periods by giving reasonable notice. Material changes will not retroactively reduce an already-started guarantee. If these Terms conflict with a signed order form, the order form controls for that conflict. Governing law, venue, and any additional dispute procedure will be stated in the applicable order form or service agreement.

17. Contact

Questions, cancellation notices, and guarantee claims must be sent through the contact information stated in your order form or through the HomeServiceRecovery website contact form, with enough information to identify your business and account.
